Terms and Conditions - Herriot Country Tours Ltd

1. Acceptance of Terms:

By booking a tour with Herriot Country Tours Ltd (hereinafter referred to as “the Company”), you (hereinafter referred to as “the Client”) agree to be bound by these Terms and Conditions. Please read them carefully.

2. Booking and Payment:

  • 2.1 Booking Confirmation: A booking is considered confirmed upon receipt of a completed booking form and the required deposit.
  • 2.2 Deposit: A non-refundable deposit of 25% of the total tour cost is required to secure your booking.
  • 2.3 Final Payment: The remaining balance of the tour cost is due 28 days prior to the tour departure date. Failure to pay the balance by the due date may result in cancellation of your booking and forfeiture of the deposit.
  • 2.4 Payment Methods: We accept debit/credit card and bank transfer.
  • 2.5 Pricing: Prices are subject to change without notice until a booking is confirmed. The Company reserves the right to correct any pricing errors.

3. Cancellation Policy:

● 3.1 Client Cancellation: ○ Cancellations must be made in writing (email accepted).

○ The following cancellation fees will apply:
■ Between initial booking and 28 days prior to departure: Forfeiture of deposit.
■ 28 to 7 days prior to departure: 50% of the total tour cost.
■ 7 days or less prior to departure: 100% of the total tour cost.
■ No refunds will be given for unused portions of the tour.

● 3.2 Company Cancellation:

○ The Company reserves the right to cancel a tour due to unforeseen circumstances, including but not limited to, natural disasters, political instability, or safety concerns.

○ In the event of a Company cancellation, the Client will be offered:
■ A full refund of all payments made.
■ An alternative tour of comparable value (subject to availability).

○ The Company is not responsible for any ancillary costs the Client may have incurred, such as flights, visas, or travel insurance.

● 3.3 Force Majeure: The Company is not liable for failures or delays caused by events beyond its control, including but not limited to, natural disasters, war, terrorism, strikes, or government actions. In such cases, the cancellation policy may be adjusted at the Company’s discretion.

4. Travel Insurance:

  • The Company strongly recommends that all Clients obtain comprehensive travel insurance covering medical expenses, trip cancellation, baggage loss, and other potential risks.

5. Health and Safety:

  • Clients are responsible for ensuring they are physically and mentally fit to participate in the tour.
  • Clients must inform the Company of any pre-existing medical conditions or disabilities that may affect their participation.
  • Clients must adhere to all safety instructions provided by the Company’s representatives.
  • The Company is not responsible for any injuries or illnesses sustained during the tour.

6. Itinerary Changes:

  • The Company reserves the right to modify the tour itinerary due to unforeseen circumstances or to improve the tour experience.

7. Liability:

  • The Company acts as an agent for hotels, and other service providers.
  • The Company is not liable for any acts or omissions of these service providers.
  • The Company’s liability is limited to the amount paid by the Client for the tour.
  • The Client is responsible for their own personal belongings.

8. Client Responsibilities:

  • Clients are responsible for obtaining and carrying valid passports, visas, and other required travel documents.
  • Clients must comply with all local laws and customs.
  • Clients are expected to behave respectfully towards the tour guide and local residents.

9. Complaints:

  • Any complaints must be submitted in writing to the Company within 7 days of the tour’s completion.

10. Governing Law:

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of England.

11. Amendments:

  • The Company reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on the Company’s website.
